A crash (accident) report completed by the Mississippi Highway Patrol (MHP) is available at each district Highway Patrol station in person ($15.00) or online ($20.00). For all other accident reports on state highways, county roads, and city streets, please contact the appropriate local law enforcement agency or obtain a crash report online ($20.00). A $5.00 handling fee is charged.
According to MS state statute 63-15-4 (4), a driver's license privileges may be suspended if they do not have vehicle insurance listed on the accident report:
(4) Failure of the owner or the operator of a motor vehicle to have the insurance card in the motor vehicle, or to display the insurance card by electronic image on a cellular phone or other type of electronic device, is a misdemeanor and, upon conviction, is punishable by a fine of One Hundred Dollars ($100.00) and suspension of driving privilege for a period of one (1) year or until the owner of the motor vehicle shows proof of liability insurance that is in compliance with the liability limits required by Section 63-15-3(j) and has paid the fines and assessments imposed and the driver's license reinstatement fees imposed by the Department of Public Safety.
If the owner of the vehicle had vehicle insurance at the time of the accident but was unable to show proof due to unknown circumstances, the owner must send proof to the Driver Service Bureau Record's Division within 60 days to avoid having their driver's license suspended. To avoid suspension, if the owner obtained insurance after the accident, they must also provide proof of insurance within 60 days of the accident.
It is critical for owners to understand that if they receive a citation for failing to provide proof of insurance in connection with an accident, they are subject to two (2) obligations. (1) It is the owner's responsibility to ensure that the citation is handled properly with the appropriate court. (2) The owner provides proof of insurance to the Driver Service Bureau. The driver's license will be suspended if both of these requirements are not met.
